Booking

Once availability has been confirmed by the Owner, a provisional booking will be agreed for 24 hours in order to allow the Renting Party time to confirm flight details etc. To confirm a booking it will be necessary to complete and return the supplied booking form. An e-mail address, telephone number and mailing address must be supplied with each booking. The sending of the booking form to the Owner confirms the Renting Party's acceptance of the terms and conditions set out below, (and as may be updated from time to time by the owners). These Terms shall be binding on all persons stated on the booking form. On receipt of the booking form and subject to the payment of the agreed deposit and continued availability, the booking will be confirmed by the Owner. Only by confirmation from the Owner should the booking be treated as a Confirmed Booking. Once the owner has confirmed the booking , the named Renting Party on the booking form will be responsible for the total rental price of the property, as agreed on the confirmation. The remaining balance of the agreed rental price and the Security Deposit must be paid in full 8 weeks prior to your departure. If the full balance of the rental cost is not paid in accordance with these booking conditions, the Owner reserves the right to cancel the booking and cancellation penalties will apply.

Security Deposit

The sending of the Booking Form confirms also acceptance by the Renting Party to pay for any damage of any kind caused during the occupancy of the property. The cost of repairs and/or replacements will be deducted from the Security Deposit prior to the return of the balance. The Security Deposit will be fully refundable 2-3 weeks after the departure from the property, providing there are no claims against it. In the event of any excess damage of any kind, excessive cleaning costs by our agents or excessive use of electricity (for example caused by leaving external doors open with the air conditioning switch on, or leaving water running) the Renting Party identified on the booking form will be held responsible for all additional costs that exceed the security deposit. Note that the amount of the Security Deposit does not limit the liability of the Renting Party.

Cancellations

Providing the owners receive written notice of cancellation not less than 8 weeks prior to the actual booking date, the reservation deposit will be forfeited but the Renting Party will not be liable to pay the full balance. It is the responsibility of the Renting Party to ensure that such a cancellation letter reaches the Owner and should satisfy themselves by way of a proof of delivery or confirmation from the Owner. Email cancellations are not acceptable. If the cancellation is received after 8 weeks prior to the start of the rental period the Renting Party is liable to pay the full balance of the final invoice. However, if the Owner is successful in re letting the property for all or part of the reservation period, the full balance or the part balance of the final invoice will be refunded. Note that the owners reserve the right to cancel any bookings for reasons that are beyond our reasonable control. In such cases the Owner will provide a written notice to the Renting Party. In such cases any monies paid will be refunded in their entirety to the Renting Party. The Owner will not be required to provide any interest, compensation or consequential loss of any kind.

Responsibilities

All persons stated on the booking form are responsible for the care of the property and agree to take reasonable care, including the locking of all external doors and gates (when resident as well as away from the property), topping up of pool water (as required) and ensuring the security alarm is activated whenever the property is unoccupied. At the end of the rental period, the Property and contents (e.g. utensils, carpets, furnishings, walls, fittings) must be left clean and tidy. It is the Renting Party's responsibility to notify the local agent immediately of any sudden equipment failure or the need to replace any consumable item included within the price, so that reasonable action can be take to rectify the situation.

Fair & Acceptable Usage Policy

All services are connected to the property and their availability is highlighted in the individual villa details. Mains services: Gas (bottled), Electricity and Water are expensive commodities in Spain. Water in particular is a scarce resource and heavy fines are imposed by the water authority for excessive use. These services should be used only as required to make your stay comfortable. Air conditioning should only be used during periods of occupancy. Air conditioning, heating and water should not be used when the property is unoccupied. The payment of any fines incurred during the rental period and such usage deemed excessive will be the responsibility of the Renting Party. Any telephone calls made from the property will be charged to the Renting Party.

Where supplied, Broadband Internet usage is provided under the governing terms of Telefonica, of the laws of Spain and of the EU. The use of the Broadband service shall not be used to access or transfer material that is offensive, or illegal. Names and contact details of members of the renting party will be provided to Telefonica and to the local authorities on their request.

Party Size

The maximum capacity of our properties is clearly indicated in the individual property details on this site. All persons accompanying the Renting Party and occupying the property must be listed on the booking form, including all children. Under no circumstances shall the renting party include members not listed on the booking form or exceed the capacity of the property. The properties cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property. No pets are permitted. Persons under 21 years of age may only reside at the properties when accompanied by parents or responsible adults. The property is available only for short-term holiday rentals and all members of the renting party agree to vacate the property at the end of the rental period. If on arrival or during the rental period any of the above conditions are not met the renting party will be immediately requested to leave the property, the Rental will be terminated and all monies paid will forfeited by the Renting Party. No compensation will be paid to the Renting Party.

Smoking/Pets

For the safety and comfort of all our guests smoking is not permitted within the property or its boundary walls. No pets are allowed.

Liability

Neither the Owners or the local agent of the property accept any responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings howsoever caused. The use of all accommodations and amenities including the pool is entirely at the user's own risk. Children must be supervised by responsible adults at all times when using the pool. Glass or crockery is not permitted within the pool area. The Owners and their local agent cannot accept any liability for any loss of rental time due to travel problem, flight delays or cancellations, industrial disputes or any events outside of their control, including any form of Force Majeure. The Owners and their local agent cannot accept responsibility for the sudden failure of villa equipment but will take immediate and reasonable action to rectify any such failure upon notification by the guests. No compensation will be paid in lieu of such failures.

Code of Conduct

Our villas are located in quiet residential neighbourhoods. The actions of all members of the renting party should not interfere with the enjoyment of either other holidaymakers or nearby residents. Please do not use the pool, play loud music or engage in any activity which may cause inconvenience to your neighbours after 10.30pm or before 08.30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers, or local residents, or causes damage to any property, the Owner or local agent reserve the right to terminate the rental agreement immediately and forthwith. The Owners or local agent will not be liable for any costs incurred, and will not pay any compensation, nor make any refunds as a result..

Arrival and Departure

The property will be available for occupancy from 4.00pm on the date of arrival and must be vacated by 10.00am (prompt) on the day of departure. Notification of arrival and departure details must be provided on the booking form. Best efforts will be made to accommodate late/early arrival and departure.

Insurance

It is a condition of the booking that all members of the Party are covered by travel insurance which carries adequate protection against delays and cancellations, loss or damage to luggage and personal belongings. All persons should have adequate medical insurance for Spain.

Force Majeure

Neither the Owner or local agent accept any responsibility whatsoever and no compensation or any other payment will be made if any cancellation or change to the terms of the booking becomes necessary due to war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural and nuclear disasters, fire, flood, adverse weather conditions, building or construction in progress within the community, technical problems with transportation, closure or congestion of airports, alterations or cancellation of schedules by carriers, or any other events beyond our control.

Owners Access

The Owner and / or local agent shall be allowed access if necessary at any reasonable time during the rental period (e.g. for weekly maid service)..

Law

This conduct is subject to and shall be construed in accordance with the laws of England and all parties hereby submit to the exclusive jurisdiction of the English Courts.
